What Constitutes Wrongful Death?

Who Can File a Wrongful Death Claim?
The deceased's spouse, children, or parents can file a wrongful death claim. Additionally, the Estate may file a Survival Action, which could benefit other recipients. Compensation received due to a Wrongful Death claim is not taxable or subject to the deceased's debts. Along with financial losses like medical bills and funeral costs, compensation can also cover things like the loss of companionship and support, as well as the deep emotional pain caused by the death.
What is Survival Action?
A Survival Action may be filed by the Estate on the deceased's behalf as if the deceased were bringing the action. These damages include pain and suffering, lost wages, and medical bills. Compensation flows through the Estate, becoming taxable and available to creditors. After covering taxes and debts, the executor gives whatever remains to the people listed as Beneficiaries in the Will. When there's no Will, the funds go to relatives based on Intestate law, starting with a spouse, parents, or children and moving to other relatives if none exist.
