CooperSurgical IVF Solution Lawsuit

CooperSurgical Recall: Understanding Your Rights in the IVF Lawsuit

Imagine the heartbreak of learning your IVF journey was derailed by a defective product. For many couples, this nightmare became reality with CooperSurgical's recalled IVF solution. CooperSurgical manufactures a nutrient-rich culture media solution that helps fertilized eggs develop into embryos for an In Vitro Fertilization (IVF) procedure.

What is In Vitro Fertilization (IVF)?

IVF is a type of assisted reproductive technology in which eggs are extracted from a woman and fertilized in a lab with sperm to create an embryo. Before the embryo is transplanted to the uterus, it is immersed in the culture media solution composed of magnesium, carbohydrates (pyruvate, lactate, and glucose), and amino acids during fertilization to assist in its development.

Understanding the CooperSurgical IVF Solution Recall

CooperSurgical recalled three batches of the solution in December, 2023, as embryos bathed in the defective product in the culture media were lost. In February 2024, the FDA posted a recall on its website. According to the FDA, nearly 1,000 bottles of the defective product, half of which were purchased by clinics in the US, were affected by the defective medium. A single bottle of embryo solution can be used for multiple IVF patients.

Impact on IVF Patients and the Ongoing CooperSurgical Lawsuit

As of February, 2024, numerous lawsuits have been filed against CooperSurgical, claiming that the solution lacked an essential magnesium nutrient which prevented the embryos' development, thus rendering them unusable. The lawsuits further claim that couples who spent years and significant amounts of money to conceive learned they had created healthy embryos only to find out that ultimately they had stopped growing.
